Court Ruling in summary proceedings: Private end user sustainable energy vs. Aqualectra N.V.

On 18 September the Court pronounced its ruling in the summary proceedings between a private end user of sustainable energy and also owner of a generating installation (to be referred to hereinafter as the plaintiff) and Integrated Utility Holding N.V. and Kompania di Distribushon di Awa i Elektrisidat di Kòrsou N.V. (to be referred to hereinafter as, Aqualectra).

Reason for the summary proceedings
The reason for the summary proceedings was the termination by the plaintiff of the ‘Standard connection agreement for small-scale sustainable generating installations for electricity up to 1000kVA’ with Aqualectra because of the installation of a battery system by plaintiff, in which excess (solar) energy is stored.
