National policy frameworks
Within the boundaries of internationally adopted and applicable frameworks for frequency policy, to a certain extent Curaçao shall decide at its discretion on the distribution of the various frequency bands.
In such case, the allocated frequency designations will be deviated from, subject to the condition that this does not cause any interference with the internationally agreed upon frequency applications.
The national frequency policy is based on a number of basic principles. These basic principles are aimed at promoting the frequency use for social, economic and cultural interests of Curaçao, warranting national security and duly observing international obligations of Curaçao in the field of frequency policy and control.
The basic principles for the national frequency policy are:
- An optimum frequency classification across the various categories of frequency use
by applying the following regulations:- The issue of frequency range takes place on the basis of the consecutive order in which the frequency applications are received, on the basis of a preferential status, by means of a comparative test, by means of a lottery, auction or by a combination of these instruments
- The issue of frequency range takes place by way of a concession or authorization
- All issues are registered in a frequency register
- If required, a frequency expropriation procedure will be applied in case of an inefficient frequency issue, the implementation of international arrangements or as a result of the introduction of a new technical system
- The application of efficient frequency use
One or more of the following measures may be applied simultaneously for this purpose:- A concession or authorization will be required for the issue of a frequency, with the exception of applications exempted from authorization and government bodies responsible for national security
- There will not be more frequencies issued than necessary for efficient use
- A fee will be required for the use or reservation of a frequency
- The equipment to be used will be required to meet certain demands
- A concession or authorization will always be attached to a term
- A concession or authorization will always be attached to prescriptions, which have efficient frequency use as objective
- When a frequency range is repossessed, an expropriation procedure will be applied
- There are continuous efforts to promote new, efficient techniques that present less of a burden on the frequency range
- Aiming towards standardization of systems by participating in international consultations and by implementing arrangements for harmonization as soon as possible
- By involving frequency users in the formulation of policies
